Terms of Use and Service Agreement
These Terms of Use ("Agreement") constitute a public offer and govern your access and use of the mobile application ("App") provided by Limited Liability Partnership "BIOME".
Acceptance of Terms
By accessing or using the App, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the App.
Service Description
The App is provided for informational and utility purposes and may include features powered by artificial intelligence.
It is currently offered free of charge. The Company reserves the right to introduce paid features in the future with notice.
Use of the the App
The App is provided "as is" without warranties. The Company does not guarantee the accuracy or reliability of AI-generated content. Use of the App is at your own risk.
Restrictions
You agree not to:
– Reverse engineer the App
– Distribute harmful or illegal content
– Use the App for unlawful or abusive purposes
Intellectual Property
All content, code, and branding in the App are the property of the Company and protected by law.
You may not copy, distribute, or modify any part without written permission.
Limitation of Liability
The Company is not liable for any damages resulting from the use or inability to use the App.
Updates and Changes
These Terms may be updated. Continued use after changes means you accept the new version.
Governing Law
These Terms are governed by the laws of the Republic of Kazakhstan.
Disputes are resolved through negotiation, or in court at the Company’s place of registration
Google Health Data Usage
By using the BIOME app, you consent to BIOME’s collection and processing of specific Google Health data (Distance, TotalCaloriesBurned) to provide analytics, personalized health recommendations, and insights. You may limit or revoke BIOME’s access anytime via app settings or your Google Account.
AI features and third-party AI processing
BIOME uses artificial intelligence technologies to provide certain features of the application, including AI chat, health and wellness coaching, nutrition analysis, risk insights, personalized recommendations, and interpretation of information provided by the user.
To provide these features, BIOME may send relevant user data to third-party AI service providers, including OpenAI API. Such data may include chat messages, Health Map data, goals, nutrition inputs, uploaded images or files, extracted information from uploaded documents, and other context necessary to generate a response or analysis.
The user must provide explicit consent before BIOME sends personal data to OpenAI API for AI-powered features. If the user does not provide such consent, AI-powered features may be unavailable or limited.
Medical disclaimer
BIOME provides health and wellness information for educational, informational, and self-management purposes only. BIOME does not provide medical diagnosis, medical treatment, or professional medical advice. BIOME does not replace consultation with a qualified healthcare professional.
The user should always consult a qualified healthcare professional in addition to using BIOME and before making medical decisions. In case of emergency or severe symptoms, the user should contact emergency services immediately.
User responsibility
The user is responsible for the accuracy of the information they provide in BIOME. Personalized recommendations, risk insights, nutrition analysis, and AI responses depend on the information entered by the user and may be incomplete or inaccurate if the provided information is incomplete or inaccurate.
Prohibited uploads
The user must not upload passports, national ID documents, bank cards, payment details, documents belonging to other people, children's documents, intimate images, illegal content, or any files that are not necessary for BIOME's health and wellness functionality.
BIOME may refuse to process, delete, or restrict access to such content if it is detected or reported.
