The application helps users organize health-related information, set personal wellness goals, receive personalized recommendations, track nutrition and activity, interact with an AI assistant, and use health-related features such as the Health Map, nutrition diary, challenges, recommendations, risk insights, and analytics.

BIOME is not a medical device, does not provide medical diagnosis, does not prescribe treatment, and does not replace consultation with a licensed healthcare professional. Any information, recommendations, risk insights, nutrition analysis, or AI-generated responses provided by BIOME are for informational and wellness-support purposes only.

If you have a medical emergency or serious symptoms, contact emergency services or a qualified healthcare professional immediately.

If you upload medical tests, lab reports, images, PDFs, or other files, we may process files uploaded by you, text extracted or interpreted from uploaded files, medical indicators contained in the files, AI-generated summaries or explanations, records of uploaded analyses, and changes made to your Health Map based on the interpreted data.

Uploaded medical files and their interpreted results may contain sensitive health data. You should upload only files that belong to you and are relevant to your use of BIOME.

Do not upload passports, national IDs, bank cards, documents of other people, children's documents, intimate images, or any files that are not needed for BIOME's health and wellness functionality.

2.5. Chat and AI interaction data

When you interact with the BIOME AI assistant, we may collect and process your chat messages, AI responses, conversation history, questions and requests related to health, nutrition, sleep, activity, wellness, goals, or other topics, images or files sent through the chat if supported, and system metadata required to operate the chat.

BIOME accesses this data only with your permission. You can manage or revoke this access through your device settings or the settings of the relevant health service.

Health and fitness data from Apple Health, Google Fit, Google Health, Health Connect, or similar services is used to personalize your BIOME experience, generate insights, show analytics, support recommendations, and adapt challenges or goals.

We do not use health and fitness data from these services for advertising or selling data to third parties.

BIOME uses artificial intelligence technologies to provide certain features, including AI chat, nutrition analysis, health-related explanations, recommendations, risk insights, and interpretation of user-provided information.

To provide these features, BIOME may send relevant parts of your data to third-party AI service providers, including OpenAI API. The data sent may include your chat messages, relevant Health Map data, nutrition inputs, uploaded image or file content if needed for the requested feature, extracted or interpreted text from medical analysis files, goals and preferences, and contextual information required to generate a useful response.

We aim to send only the data that is reasonably necessary to provide the requested AI-powered feature.

AI-generated responses may be inaccurate, incomplete, or unsuitable for your specific situation. You should not rely on BIOME as a substitute for professional medical advice, diagnosis, or treatment.

If you allow push notifications, BIOME may send you notifications related to onboarding, reminders, challenges, nutrition diary, health and wellness insights, lab analysis processing results, app usage and product updates, and subscription or account status.

You can disable push notifications at any time in your device settings.

We may also send transactional emails, such as registration confirmation, password reset, account security messages, subscription-related messages, or important updates about the service.

8. Legal basis for processing

Depending on your location and applicable law, we may process your personal data based on one or more of the following legal bases: your consent, performance of a contract with you, compliance with legal obligations, our legitimate interests such as providing, securing and improving BIOME, and protection of vital interests where applicable.

For sensitive health data, we generally rely on your explicit consent or another applicable legal basis under relevant law.

You may withdraw your consent where processing is based on consent. Withdrawal of consent may limit or disable certain BIOME features.

9. Data storage and retention

We store your data for as long as necessary to provide BIOME services, maintain your account, comply with legal obligations, resolve disputes, prevent fraud or abuse, and enforce our agreements.

Different categories of data may be stored for different periods depending on the feature and legal requirements.

When you delete your account, we delete or anonymize personal data associated with your account, unless we are required or permitted to retain certain data for legitimate reasons, such as legal compliance, payment and accounting records, fraud prevention, dispute resolution, security logs, and backup retention for a limited period.

After account deletion, BIOME will delete or anonymize data associated with your account, subject to legal, security, accounting, or technical retention requirements.

Deleting the BIOME app from your device does not automatically delete your account or server-side data.

11. Your rights

Depending on your location and applicable law, you may have the right to access your personal data, correct inaccurate data, delete your personal data, restrict processing, object to certain processing, withdraw consent, request data portability, request information about how your data is used, and lodge a complaint with a data protection authority.

These measures may include encrypted transmission of data, access control, authentication mechanisms, server-side security measures, monitoring and logging, limitation of access to personal data, separation of permissions where applicable, and backup and recovery procedures.

No method of transmission or storage is completely secure. We cannot guarantee absolute security, but we work to protect your data using reasonable and appropriate safeguards.

13. International data transfers

BIOME may process and store data in countries other than your country of residence. Third-party service providers, including AI, hosting, analytics, and infrastructure providers, may also process data internationally.

Where required by applicable law, we use appropriate safeguards for international data transfers, such as contractual protections or other legally recognized mechanisms.

BIOME is designed for health and wellness-related use. You should not upload or send passports or national ID documents, bank cards or payment card details, documents that belong to other people, children's documents, intimate images, illegal content, or files unrelated to BIOME's health and wellness functionality.

If you send such data, we may delete it, refuse to process it, or take other steps necessary to protect privacy and security.

We may update this Privacy Policy from time to time.

If we make material changes, we may notify you through the app, by email, or by other appropriate means. The updated version will be available on our website and/or in the application.
